What happens when the executor has been appointed and now the executor has died but the distribution of the estate has not occurred? Diane and Kelly lost both their mother and grandmother in the past year.  Their mother was living in their grandmother’s house and had been named executrix in the grandmother’s Last Will and Testament.  When their grandmother passed, their mother began the probate process. She probated the Will, received letters of Testamentary and began to work on changing the deed on the house from the grandmother’s name to hers.  But as with many people, COVID hit Diane and Kelly’s family and their mother died prior to getting the deed changed.  We looked at the grandmother’s Will, and it did not name Diane or Kelly as successor executrixes.  How to fix this problem.  The next step is to file for Letters of Administration with a Will Annexed.  It may be an extra hoop, but filing this Petition now gives Diane and Kelly the ability to get the deed from their grandmother’s name, to their mother’s name, and then to either their names or even the ability to sell the house and distribute the profits of the sale.
